Recently, a panel of Brazil’s federal supreme court justices collectively voted to uphold orders that suspended the use of Elon Musk’s social network X nationwide. Despite the unanimous decision, Justice Luiz Fux expressed some reservations about a specific measure in the order. This measure allows the court to fine individuals or businesses that engage in “subterfuge,” such as using VPNs to access X while it remains blocked. This decision came after the court’s top justice, Alexandre de Moraes, issued controversial suspension orders, following a warning to Musk and X about appointing a legal representative in Brazil within 24 hours or face penalties, including suspension of activities.
Defiance and Consequences
X had previously defied court requests to take down accounts or posts that violated Brazil’s laws on political misinformation and hate speech online. As a result, the court also took action by freezing the financial assets of another business led by Musk, Starlink, in Brazil to guarantee that X would pay its fines. Furthermore, Brazil’s telecoms regulator, Anatel, instructed internet service providers, including Starlink, to block access to X in the country until it complies with the court’s orders. Despite this, Starlink has communicated to the regulator that it does not intend to follow the directives and may face the risk of having its operating licenses revoked in Brazil.
Musk and his companies have openly criticized de Moraes’ actions as “illegal,” citing a lack of due process in the issuance of the court’s orders. Musk escalated his discontent over the Labor Day weekend by calling for an end to U.S. foreign aid to Brazil and threatening reciprocal actions against those who support the Brazilian regime. These threats were made without substantial evidence to support his claims. Musk went as far as labeling de Moraes as a “criminal” and warning of seeking reciprocal seizure of government assets if the Brazilian government does not return the “illegally seized property” of SpaceX.
The decision to block X in Brazil has sparked a debate among users and politicians regarding the legitimacy of the ban. Many Brazilians have expressed difficulties and doubts about navigating other social media platforms in the absence of X. However, some social media users in Brazil are transitioning to alternative platforms. For instance, Bluesky reported a surge in user activity from Brazil, indicating a shifting trend towards other social networks. Despite the controversy surrounding X’s suspension, neither SpaceX nor Musk has provided immediate commentary on the situation.
Musk’s Stance on Free Speech
Musk has positioned himself as an advocate for free speech, yet his actions have been inconsistent. While he has resisted orders to remove content in Brazil and Australia, X has removed critical content targeting ruling parties in Turkey and India under his oversight. This inconsistency raises questions about Musk’s commitment to free speech principles and his approach to content moderation on social media platforms.
The ongoing dispute between Brazil’s supreme court and Elon Musk’s social network X reflects a broader conversation about free speech, censorship, and the responsibilities of tech companies operating globally.
