In a recent investigation conducted by India’s antitrust body, it was revealed that Apple had been engaging in abusive practices by exploiting its dominant position in the market for app stores on its iOS operating system. The Competition Commission of India (CCI) has been probing Apple Inc since 2021 for potential abuses of its dominant position in the apps market, particularly by compelling developers to utilize its proprietary in-app purchase system. Apple has vehemently denied any wrongdoing, arguing that it is a minor player in the Indian market compared to devices that operate on Google’s Android system.
The 142-page confidential report by the CCI’s investigations unit highlighted Apple’s significant influence over how digital products and services are brought to consumers, primarily through its iOS platform and App Store. According to the report, Apple’s App Store is an unavoidable partner for app developers, who are left with no choice but to comply with Apple’s unfair terms, including the mandatory use of Apple’s proprietary billing and payment system. This antitrust investigation in India comes amidst growing scrutiny of Apple’s business practices in other regions. European Union antitrust regulators recently accused Apple of breaching the bloc’s tech rules, potentially leading to substantial fines. Furthermore, Apple is facing investigations related to new fees imposed on app developers. In response to the EU’s Digital Markets Act, Apple proposed allowing software developers to distribute apps to EU users outside of the App Store. This move reflects increasing pressure on Apple to make its practices more transparent and fair.
Apple has yet to respond to the findings of the Indian antitrust investigation. However, in its submissions to the CCI, Apple argued that its market share in India is insignificant compared to Google, which dominates the market. The company also defended its in-app payment system, stating that it is crucial for maintaining the safety and integrity of the App Store. Despite Apple’s arguments, the CCI maintained that Apple’s payment policy adversely affects app developers, users, and other payment processors, emphasizing the need for a more equitable system.
The CCI’s report marks a critical stage in the Indian investigation, as it will now be reviewed by senior officials of the watchdog. Apple and other parties involved will have the opportunity to respond before a final decision is made, which could include monetary fines and directives to change business practices. The case was initially filed by a non-profit group called “Together We Fight Society,” which alleged that Apple’s in-app fees stifled competition and raised costs for developers and consumers.
